Terms & Conditions
These terms will apply to all services provided by Reflections HD Photography ("Robin Jeffries". "Jack Akana Jr.", "us" or "we") to you, the customer, ("you"). We will not accept any variation to these terms and conditions unless specifically agreed in writing by Robin Jeffries or Jack Akana Jr. By making a booking you have agreed to these terms and conditions in full.
Booking Fee /Deposit Payments
A non-refundable deposit of 50% down is required to secures the date, time and services of Reflections HD for the photo session. The booking fee will be deducted from the cost of the client's session when calculating the final balance due. Payment in full of the remaining balance will be due on the day of the client shoot session. Shoot session that are postponed to a later date will retain the fee as long as the photographer can reschedule for the new date and time.
Cancellation
If Reflections HD has to cancel the appointment for reasons beyond their control (death, injury, sickness, etc.), their liability shall be limited to a full refund of all monies paid. If the Client cancels the appointment an unconditional refund policy exists up until 7 days prior to the reserved slot at which point the full Booking Fee will be retained by Reflections HD.
Postponement Due to Adverse Weather
If the appointment has to be cancelled by Reflections HD due to adverse weather conditions a new, mutually agreed appointment will be made. However, if the Client would like a Booking Fee refund, this will be granted.
Copyright & Reproductions
Reflections HD (The Photographer) shall own the copyright on all images created and shall have the exclusive right to make reproductions and edits of any kind. The Photographer shall only make reproductions for the Client or for the Photographer’s portfolio, samples, self-promotions, entry in photographic contests or art exhibitions, editorial use, website, or for display within or on the outside of the Photographer’s studio.
Limited Liability
The Client understands that they are hiring the photographer based on their specific highly-stylized approach and has seen portfolio/photo examples prior to booking with the photographer. Any failure by Reflections HD to deliver any specific photograph shall not be a breach of this agreement, shall not result in a refund to the client of any money paid to Reflections HD, and Reflections HD shall not provide any other remedy to The Client.
Reflections HD takes the utmost care and respect when creating photographs. This includes but is not limited to the exposure, processing, post-production, retouching, lighting, and delivery of all photographs. In the event that Reflections HD fails to fulfill their obligations under the agreement, Reflections HD shall not be liable for any amount of funds past the amount paid for service or contract. The initial session fee paid by "The Client" will represent the full amount of damages due to "The Client". This limitation of liability shall also apply in the event that the digital negatives are damaged, lost through mail or transit, or damaged through camera malfunction, or by any other means arising under or related to this agreement.
Injury Liability
"The Client" is liable for their own personal well-being during a photography session. In the unlikely event that injuries to "The Client" are suffered during the scheduled session, Reflections HD is in no way responsible, financially or otherwise. The Client understands that they have the right to decline requests from The Photographer if their well-being is in harms way. In addition, The Client cannot hold the venue in which the session takes place responsible for any injuries that may occur during the session.
Delivery
Reflections HD will endeavor to deliver all digital photo files as quickly as possible through an online photo gallery. In the client online photo gallery the client is responsible for downloading all digital photos to their computer or jump drive within a 2 week period. During some busy season digital photo delivery could take up to 2-3 weeks.
